Understanding the ICBC Claims Process
If you’re involved in a car accident, one of the first things you need to do is file an accident report with the Insurance Corporation of British Columbia (ICBC), either by phone or online. Here’s a brief overview of how the claims process typically unfolds.
Reimbursement for repairs
If the other driver was at fault, ICBC will cover your repair bill. They will also pay for any damage that you’ve caused to the other vehicle.
If you were at fault and you have collision insurance with ICBC, you’ll pay the deductible and ICBC will pay the rest. If you caused the accident and you don’t have collision insurance, you’ll need to pay out of pocket.
While basic Autoplan insurance from ICBC is mandatory, collision coverage is an add-on. You have the option of either getting it through ICBC or seeking more affordable and comprehensive coverage with a private insurer
An ICBC adjuster will conduct an investigation to determine who was at fault. If you’re found fully or partially at fault and you disagree with the decision, you can request that an ICBC claims manager review the case. If you don’t agree after the secondary review, you have 60 days to apply for a Claims Assessment Review. If you’re still unsatisfied at the end of this process, you can choose to take the decision to court.
Filing a tort claim
If the other driver was at fault, you may be entitled to compensation for losses including damages for pain and suffering, lost wages and future medical care. You may file a tort claim on your own behalf or hire legal representation.
If you aren’t at fault, ICBC will usually offer you a settlement, which you can accept or negotiate.
Reimbursement for injury
An ICBC adjuster will review all medical information and expenses you submit. You’ll receive medical care benefits of up to $150,000, regardless of whether or not you were at fault. A personal injury claim can be made in addition to any claim for benefits.
